This policy (together with our End User Terms of Use and any other documents referred to in the relevant terms) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. 1. The Data Controller

Depending on how your information is gathered the data controller (for the purpose of the Data Protection Act 1998 (the “Act”)) may be iVoucher Limited, a selected third party or a Restaurant or some or all of us. We set out below various scenarios (as guidance only) to help you understand who may be in control of your data.

This policy deals specifically with our processing of your data where we are the data controller of that data. If the data controller is a selected third party or a Restaurant then you will need to contact that third party or Restaurant for further information regarding their processing of your personal data.

Provided that you have not opted-out from certain uses of your information:

1. (a) If you have given your contact details (e.g. mobile number, e-mail address etc.) directly to a Restaurant (other than via one of the iVoucher methods below) then the Restaurant alone will be the data controller of that information. iVoucher will merely process this data on the instructions of the Restaurant.
2. (b) If you have sent an SMS Request, with reference to a specific Restaurant, then the Restaurant will be data controller of your information. iVoucher may also process this data on the instructions of the Restaurant.
3. (c) If you have sent an SMS Request (without reference to a specific Restaurant) then iVoucher and its selected third parties will be the data controllers of your information.
4. (d) If you have Signed-Up then iVoucher and its selected third parties will be the data controllers of your information.

2. Information we may collect from you

We may collect and process the following data about you:

1. (a) Information that you provide by filling in forms on our Website (including without limitation email details). This includes information provided at the time of registering to use our Website, subscribing to our service, posting material or requesting further services. We may also ask you for information, and when you report a problem with our Website.
2. (b) Information that you provide by sending in an SMS Request.
3. (c) If you contact us, we may keep a record of that correspondence.
4. (d) We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.
5. (e) Details of transactions you carry out through our Website.
6. (f) Details of your visits to our Website including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.

3. IP addresses and cookies

We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.

If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please tick the relevant box situated on the form on which we collect your data (the registration form), click an unsubscribe link, change the settings in your account, text “STOP” to 88825 or contact the sender of any messages and state your desire to opt-out (as applicable).

We may make use of the personal data we have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience.

6. Disclosure of your information

We may disclose your personal information to any member of our group from time to time, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

We may disclose your personal information to third parties:

1. (a) In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
2. (b) If we or substantially all of our assets and are acquired by a third party, in which case personal data held by it about its subscribers will be one of the transferred assets.

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes.
